You obtained a favourable HKIAC award ordering the supplier to refund the purchase price and pay damages and arbitration costs. The performance deadline has passed, but the supplier has not paid. It has no obvious Hong Kong assets; its factory, accounts, and equity are in Mainland China.
The task is no longer to prove breach. It is to turn the Hong Kong award into a Mainland enforcement basis and locate property that can produce a recovery. Confirm the award and performance date, preserve the application period, identify debtor and assets, select the competent court, complete Chinese documents and identity proof, and then address preservation, refusal arguments, and disposal.
Hong Kong awards have an established Mainland enforcement framework, but eligibility to apply does not guarantee collection. Assets, priority, insolvency, and document quality still determine the commercial result.
Confirm that it is a Hong Kong arbitral award
An HKIAC-administered case does not necessarily produce a Hong Kong award. The decisive factor is the seat . Term Seat of arbitration
The seat is the legal home of the arbitration; it fixes the supervisory court and the enforcement route. Under HKIAC 2024 Rules Article 14.1, the seat defaults to Hong Kong absent contrary agreement. HKIAC 2024 Ruleshkiac.orghkiac.org
Statute Not NY Convention
Hong Kong awards are not New York Convention awards in the Mainland; the 1999 Arrangement, supplemented in 2020, is the controlling instrument. Its refusal grounds mirror Convention Article V. Arrangement text: HK DoJwww.doj.gov.hkwww.doj.gov.hk
Check whether the award is final, partial, or interim; states the seat, date, and signatures; has any correction, interpretation, or additional award; and expresses principal, interest, costs, currency, performance date, and non-monetary obligations with enough precision for enforcement.
The HKIAC Rules allow timely applications for correction, interpretation, or an additional award on omitted claims. Those procedures do not reopen the merits, but may change the final document package.
A Hong Kong set-aside application and Mainland resistance to enforcement are different procedures. A set-aside application under Hong Kong’s Arbitration Ordinance generally has a three-month window after receipt of the award , but a full set-aside guide is outside this article and requires Hong Kong-law advice.

The application period is generally two years, but do not count mechanically from the award date
The 1999 Arrangement refers limitation to the law of the place of enforcement . Under Article 250 of the PRC Civil Procedure LawArticle 250 of the PRC Civil Procedure LawThe application period is two years. Its start depends on whether the instrument sets one performance period, instalments, or no performance period.Official text · Shanghai Development and Reform Commission , the general period is two years:
- from the last day of a stated performance period;
- from the expiry of the last instalment where performance is staged; or
- from effectiveness of the legal instrument where no performance period is stated.
Statute CPL Art. 250 period
Article 250 of the PRC Civil Procedure Law sets the two-year application period; suspension and interruption follow the limitation rules. Older versions numbered the same rule Article 239 or 246. Official textfgw.sh.gov.cnfgw.sh.gov.cn
Correction or interpretation, performance agreements, partial payment, and lawful suspension or interruption may affect a particular calculation. Do not add two years to the award date in a spreadsheet and stop there.
Do not wait until the final months. Overseas corporate documents, authority, Apostille, Chinese translation, asset investigation, and court supplements take time, while the debtor may accelerate asset disposal.
Find assets before choosing the court
An application may be made to the relevant Intermediate People’s Court where the respondent is domiciled or its property is located.
First verify the award debtor’s registered Chinese name, Unified Social Credit Code, and status. A trading name, brand, or factory name is not the legal identity. If the award binds one contracting company, the court does not directly enforce against an affiliate merely because that affiliate has assets.
Second, build an asset map: accounts, real estate, equipment, inventory, vehicles, equity, receivables, intellectual property, and existing seizures. If assets sit in several places, compare value, identifiability, creditor priority, disposal cost, and insolvency status.
Lack of an asset lead may not prevent acceptance, but it makes the commercial outcome less predictable. A favourable award cannot create money in an empty account.
Link the award, arbitration agreement, and corporate identity in one document package
The 1999 Arrangement requires an application, arbitral award, and arbitration agreement. A Mainland application should be in Chinese and identify the parties, grounds, relief, and location and status of property.
The package commonly includes the award and any correction, interpretation, or additional award; complete arbitration agreement and contract; claimant registration, good standing, and representative records; authority documents; respondent registration; asset leads; and certified Chinese translations of non-Chinese materials.
Overseas corporate and authority documents must satisfy Mainland proof rules. Since 7 November 2023, the Apostille Convention generally replaces consular legalisation for public documents within its scope between contracting states. Non-contracting states, out-of-scope materials, and court-specific formats still require individual checking.

Courts may differ in translation, certification, copy, and electronic-filing practice. Confirm the list with the intended court instead of relying only on an online checklist.
The Supplemental Arrangement permits preservation and parallel applications
First, a party may seek preservation or compulsory measures under the law of the enforcement place before or after the court accepts the enforcement application. An urgent post-award transfer does not necessarily require waiting until recognition review is complete, but jurisdiction, necessity, scope, and security still apply.
If Mainland property was preserved during arbitration, check duration, value, and transition into enforcement. Preservation does not allocate the asset proceeds to the award creditor.
Second, when the debtor has a domicile or enforceable property in both Hong Kong and the Mainland, applications may proceed in both places. The courts may exchange information, but combined recovery cannot exceed the award.
Maintain a ledger for principal, interest, costs, every deduction or settlement payment, and the outstanding balance. Parallel enforcement increases access to property, not the right to double recovery.
The court reviews limited refusal grounds, not the contract merits again
Under Article 7 of the 1999 Arrangement, the respondent may rely on limited grounds:
- incapacity or an invalid arbitration agreement;
- lack of proper notice or inability to present the case;
- an award beyond the arbitration agreement’s scope;
- tribunal composition or procedure contrary to party agreement or seat law;
- an award not yet binding, or set aside or suspended;
- a dispute not capable of arbitration; or
- enforcement contrary to Mainland social and public interests.
Where an excess-of-scope part can be separated, the remainder may still be enforced. A court does not retry the arbitration because the supplier repeats that it did not breach.
Prepare service records, participation documents , arbitrator appointment and disclosures, jurisdiction decisions, procedural orders, submissions, and hearing opportunities. Refusal challenges usually turn on the paper trail: proof of service, notice of appointments, and opportunities to be heard. Keep the tribunal correspondence and courier records from day one. Recognition is followed by asset control, disposal, and distribution
Recognition turns the award into a Mainland enforcement basis. The court then searches for, freezes, deducts, seals, values, auctions, or sells specific property.

Cash may be deducted relatively directly. Real estate, equipment, and equity usually require valuation and sale; receivables require third-party assistance. Non-monetary relief must be precise enough for the court to determine performance.
The Supreme People’s Court’s 2026 maritime typical case HKIAC/A24057 concerned vessel trials, delivery, settlement, and monetary relief. The Nanjing Maritime Court held that recognition review retained independent procedural value despite bankruptcy review and that sufficiently specific conduct and calculable obligations could be enforced. Recognition does not bypass formal insolvency or create priority. The creditor may still need to file its claim and follow security, ranking, and distribution rules.
A no-assets closure does not extinguish the debt
If no property is found, the court may terminate the current enforcement procedure. The award debt does not disappear; enforcement may be resumed when a new account, equity interest, property, or receivable is located.
Continue monitoring registrations, equity, litigation, insolvency notices, and major asset changes. An instalment settlement should address payment milestones, security, interest, credit for payments, resumption after default, and the point at which controls are released. Do not surrender all measures for the first instalment or a promise.
Use the correct enforcement sequence
Confirm the award, performance period, and two-year period; find assets and choose the court; prepare the Chinese application, award, arbitration agreement, corporate identity, and authority. Consider preservation if assets may move and parallel applications if both places contain assets, while preventing over-recovery. Then address refusal grounds, disposal, and settlement.
Conclusion
An HKIAC award is not the same as money recovered. Mainland enforcement usually turns on timely filing, executable assets, and a complete proof chain connecting the award, arbitration agreement, parties, and procedure. Recognition review is limited, but asset control, disposal, and distribution still follow.
Parallel Hong Kong and Mainland enforcement is possible without over-recovery. A temporary no-assets closure does not extinguish the debt. Early asset mapping and a recovery ledger are what turn a favourable award into actual collection.

How long do I have to enforce an HKIAC award in Mainland China?
The reciprocal arrangement applies the limitation law of the place of enforcement. Under the current PRC Civil Procedure Law, the general application period is two years. The start date differs for a stated performance period, instalments, or no stated period, and correction, interpretation, performance agreements, suspension, or interruption may affect the calculation. Do not simply add two years to the award date.
Can I apply in Hong Kong and the Mainland at the same time?
Yes. The Supplemental Arrangement permits applications in both places when the debtor has a domicile or enforceable assets in each. The courts may exchange enforcement information, but total recovery cannot exceed the amount awarded. Maintain a recovery ledger and disclose payments promptly.
Can recognition proceed while the supplier is under bankruptcy review?
A 2026 Supreme People's Court maritime case states that recognition and enforcement review has independent procedural value and is not automatically stayed by bankruptcy review. Recognition does not permit priority payment outside formal insolvency, however; the creditor may still need to file its claim and follow priority and distribution rules.
Will a Mainland court re-examine who was right under the contract?
Usually not. The court reviews limited refusal grounds, including incapacity or invalid agreement, lack of proper notice or opportunity to present the case, excess of scope, improper tribunal or procedure, a non-binding or set-aside award, non-arbitrability, and Mainland public interest. It is not an appeal on the merits.
